Terms of Service for Learnews

Welcome to Learnews! These Terms of Service ("Terms") govern your access to and use of the Learnews mobile application (the "App") operated by Osman Emre Temizyurek, an individual based in Australia ("we", "us", or "our").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, you must not use the App.

1. Eligibility

You must be at least 13 years of age to use Learnews. If you are between 13 and 18 years old, you confirm that you have obtained your parent or legal guardian's permission to use the App and to agree to these Terms.

By using the App, you represent that:

You meet the minimum age requirement.
You have the legal capacity to enter into a binding agreement.
You will use the App in compliance with all applicable laws.

2. Account Creation and Security

To use the App's full features, you must sign in using "Sign in with Apple". You are responsible for:

Maintaining the security of your Apple ID and the device on which Learnews is installed.
All activities that occur under your account.
Notifying us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that we suspect have been compromised.

3. License to Use the App

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on Apple devices that you own or control, solely for your personal, non-commercial use.

This license is also subject to the Apple Licensed Application End User License Agreement (the "Apple EULA") available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. In the event of any conflict between these Terms and the Apple EULA, the Apple EULA shall prevail with respect to the use of the App on Apple devices.

4. Acceptable Use

You agree not to:

Use the App for any unlawful purpose or in violation of any applicable laws.
Reverse engineer, decompile, or attempt to extract the source code of the App, except as permitted by law.
Modify, adapt, or create derivative works based on the App.
Use any automated means (bots, scrapers, etc.) to access the App or interfere with its operation.
Attempt to gain unauthorized access to our servers, other users' accounts, or any related systems.
Use the App to harass, abuse, or harm another person.
Resell, redistribute, or sublicense the App or its content.
Bypass any feature designed to limit usage or protect the integrity of the App.

5. AI-Generated and Third-Party Content

Learnews adapts news articles using artificial intelligence (Anthropic's Claude AI) to match your selected English proficiency level. You acknowledge and agree that:

AI-generated content may contain inaccuracies, omissions, or errors.
Adapted articles should not be relied upon as a substitute for original news sources, especially for critical information.
News articles are sourced from third parties (NewsAPI) and we do not endorse, verify, or take responsibility for their content.
Word definitions are sourced from Wiktionary and may not always be accurate.

You use AI-generated content and third-party content at your own risk.

6. Intellectual Property Rights

6.1 Our Rights

The App, including its software, design, branding, and original content, is owned by Osman Emre Temizyurek and is protected by copyright, trademark, and other intellectual property laws. We reserve all rights not expressly granted to you in these Terms.

6.2 Third-Party Content

News articles displayed in the App are owned by their respective publishers. We do not claim ownership of third-party news content. Adaptation of articles for educational purposes is performed in good faith and in accordance with fair use principles.

6.3 User Content

Any content you create within the App (such as your vocabulary list or reading history) belongs to you. By using the App, you grant us a license to store and process this content solely to provide the App's services to you.

7. Premium Features (Future)

Learnews currently offers all features free of charge. In the future, we may introduce premium features available through subscription. If we do:

Pricing, billing, and renewal terms will be clearly disclosed before any purchase.
Subscriptions will be processed through the Apple App Store and governed by Apple's billing policies.
Cancellation and refund policies will follow Apple's standard rules.

These Terms will be updated to include subscription-specific provisions before any premium features launch.

8. Termination

You may terminate your account and stop using the App at any time by deleting your account through Settings → "Delete All My Personal Data" within the App.

We may suspend or terminate your access to the App at our discretion, without notice, if you violate these Terms or engage in conduct that we deem harmful to other users, our service, or third parties.

Upon termination:

Your right to use the App ends immediately.
Your account data will be deleted in accordance with our Privacy Policy.
Any provisions that by their nature should survive termination (such as ownership, disclaimers, and limitations of liability) will remain in effect.

9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

The App will be uninterrupted, error-free, or completely secure.
The information provided through the App (including AI-adapted content, news, and translations) is accurate, complete, or reliable.
Defects in the App will be corrected.
The App is free from viruses or other harmful components.

Your use of the App is at your sole risk. You are responsible for any decisions made based on information obtained through the App.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL OSMAN Emre Temizyurek, NOR ANY OF HIS AGENTS OR CONTRACTORS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE APP.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above limitations may not apply to you. In such cases, our liability will be limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Osman Emre Temizyurek from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

Your use or misuse of the App.
Your violation of these Terms.
Your violation of any third-party right, including intellectual property or privacy rights.

12. Apple-Specific Provisions

You acknowledge that these Terms are between you and Osman Emre Temizyurek only, and not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content.

You agree that:

Apple has no obligation to furnish any maintenance and support services with respect to the App.
In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever.
We, not Apple, are responsible for addressing any claims relating to the App, including but not limited to product liability claims, claims that the App fails to conform to legal requirements, and claims arising under consumer protection laws.
In the event of a third-party claim that the App or your use of it infringes that third party's intellectual property rights, we, not Apple, will be responsible for the investigation, defense, settlement, and discharge of such a claim.
Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this document. If the changes are significant, we will notify you through the App before the changes take effect.

Your continued use of the App after the updated Terms take effect constitutes your acceptance of the changes. If you do not agree to the new Terms, you must stop using the App and delete your account.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Australia, without regard to its conflict of law principles.

Any disputes arising out of or relating to these Terms or the App shall be resolved in the courts located in Australia, unless otherwise required by applicable consumer protection laws in your jurisdiction.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
